On July 10, 2020, Ordinance No. 186703 became effective, which contains amendments to Article 4, Chapter X of the Los Angeles Municipal Code (“LAMC” or “Code”). This ordinance authorizes DCR, at its discretion, to issue Temporary Approval to eligible Applicants. This ordinance further establishes a process for Applicants to request a Business Premises relocation.

DCR seeks to determine whether P3RR1 Applicants eligible for further processing have site control and whether Applicants intend to file an application modification request for a Business Premises relocation. As such, Applicants that were deemed eligible for further processing in Phase 3 Retail Round 1 (“P3RR1”) before January 1, 2020 are hereby instructed to respond to DCR within 7 calendar days of the date of this communication to confirm: (1) if the Applicant retains site control of the Business Premises identified in their application; and (2) if the Applicant intends to file an application modification request for a Business Premises relocation before the application is further processed. Applicants who do not respond will continue to be associated with their current Business Premises location and may request a relocation at a later time.

Applicants who intend to relocate will receive further instructions from DCR regarding the process to file an application modification request under Los Angeles Municipal Code Section 104.03(e)(1). Those Applicants will need to identify a new Business Premises location within the same Community Plan Area as the original Business Premises location.

Please note, Applicants who retain site control and do not seek a Business Premises relocation may progress through the application process more quickly than those who do not have site control, or have site control but are seeking a Business Premises relocation.

DCR will provide additional instructions to Applicants on how to proceed in the application process and how to apply for Temporary Approval under LAMC Section 104.06(d).
